The Supreme Court has questioned the Tamil Nadu government’s role in temple administration while hearing a case involving the alleged theft and replacement of an antique idol at Sri Kapaleeswarar Temple in Chennai. The proceedings concern a challenge to a Madras High Court ruling that quashed a First Information Report (FIR) against Venu Srinivasan, chairman emeritus of TVS Motor Company and a board member of Tata Sons. The bench of Justices Aravind Kumar and Vipul M. Pancholi has scheduled the next hearing for October 29.

During the hearing, Justice Aravind Kumar questioned whether similar arrangements existed in other religious institutions in Tamil Nadu, asking whether state-appointed officials entered places of worship to prepare inventories. The discussion centred on the extent of government involvement in Hindu temple administration. Tamil Nadu’s Additional Advocate General, Prashanto Chandra, referred to provisions under the Waqf Act, prompting the judge to distinguish between community-linked representation and direct state involvement. The exchange brought renewed attention to the debate over government supervision of religious institutions.

At the heart of the case is an antique stone peacock idol associated with the Punnaivananathar shrine at Sri Kapaleeswarar Temple in Chennai’s Mylapore neighbourhood. According to the complaint, the original idol depicted a peacock holding a flower in its beak. The complainant alleged that it disappeared during renovation work in 2004 and was replaced with another idol depicting the bird holding a snake. The allegations have raised questions about the preservation of religious artefacts and the accountability of those involved in temple renovation projects.

Temple activist Rangarajan Narasimhan brought the matter to the authorities’ attention in 2018, around 14 years after the alleged incident. The Tamil Nadu police’s Idol Wing subsequently registered an FIR and investigated the matter. A final report filed in 2022 named Srinivasan and other individuals. Srinivasan had served on a government-appointed committee overseeing renovation work at the temple. However, the allegations remain subject to legal proceedings, and the filing of a police report does not establish criminal guilt.

The case took a significant turn on February 16, 2024, when the Madras High Court quashed the FIR against Srinivasan. Narasimhan subsequently approached the Supreme Court, challenging that decision. The Supreme Court is now examining the challenge to the High Court’s ruling; it has not yet delivered a final determination on whether the alleged idol theft occurred or whether any individual bears criminal responsibility.

The dispute has also highlighted questions about the preservation of religious heritage at Sri Kapaleeswarar Temple. Those seeking further investigation argue that antique idols are valuable cultural and religious objects whose disappearance or unauthorised replacement deserves careful scrutiny. At the same time, allegations against named individuals must be assessed on the evidence and in accordance with due process. The court’s consideration will involve the applicable law, the investigation record and the reasoning behind the High Court’s decision.

The controversy has renewed debate over the role of Tamil Nadu’s Hindu Religious and Charitable Endowments Department, which oversees many Hindu temples across the state. Supporters of government supervision point to the need for financial transparency and the protection of temple assets. Critics, however, question the extent of state control over religious institutions and argue that temple management should retain greater independence. The Supreme Court’s observations have brought these competing concerns into focus, although questions raised during oral arguments should not be treated as final judicial findings.

For devotees and heritage advocates, the proceedings extend beyond the dispute over a single idol. They concern the protection of objects associated with worship, the integrity of temple administration and public confidence in investigations involving religious property. The next hearing on October 29 is expected to give the parties another opportunity to present their arguments. Until the Supreme Court rules on the matter, the challenge remains pending, and the allegations concerning the disputed idol must be treated as unproven.

The outcome could have implications for the continuing discussion over accountability and oversight at Sri Kapaleeswarar Temple and other religious institutions in Tamil Nadu. For now, the focus remains on the legal arguments before the court and whether the High Court’s decision to quash the FIR should stand.
