Horrific and heart wrenching news have been emerging from Rajasthan for a few years now. But the latest news will force us to ponder where we have reached as humanity and has the administrative machinery collapsed completely in the state?

NHRC takes suo motu cognizance of reported Flesh trade, rapes in lieu of financial debt

What do you think can be the penalty for the non-payment of loans? Civil and criminal cases, seizure of their property or even jail term, right? But what if, the financial creditors start using the debt to take illegal, inhumane advantage and the debtor starts to oblige? Unfortunately, this sheer incorrigible act becomes blood-curdling when the society makes it a norm and, rather than ending this inhumane act, encourages this wicked sense of JUSTICE.

This is not a prelude to a horrific fictional story, but rather happening in reality in certain areas of Rajasthan. Apart from that, sometimes reality can be even darker and more gruesome than fiction. The reported cruel happenings in the state are far more gut-wrenching than the above stated scenario.

Evidently, the National Human Rights Commission (NHRC) has taken suo motu cognizance of a reported flesh trade, auctioning of minor girls and the refusal thereof, resulting in the rape of their mothers to settle financial disputes. After taking the matter in its hand, the NHRC has issued a notice to the Gehlot government on the matter.

The horrendous crime continues with impunity

The matter came to light when some media reports highlighted that in half-a-dozen districts of Rajasthan, girls are being auctioned on stamp papers in matters of financial dispute. Moreover, in case of refusals, their mothers are subjected to rape on the diktats of the local caste panchayats for the settlement of these financial disputes.

Several media reports had documented the ordeals of many victims of such horrendous crimes. Following which, the NHRC took a suo moto cognizance of this matter.

The Human Right body has stated that if the media reports are found to be true, it would be tantamount to human rights violations of the victims. That is why; NHRC issued the notice to the Chief Secretary of Rajasthan. In the notice, it has asked for a detailed report on the matter, along with an action taken report, qua measures already taken and, if not, proposed to be taken to prevent such gory incidents.

Pertinent to note, that this was happening in at least six districts in Rajasthan and the state government didn’t wake from its slumber. Even now, the red-tapism and legal nitty-gritty are becoming hindrance as the state government has four weeks’ time to file their response in a case of ongoing perpetual crime.

As per initial findings of NHRC, these minor girls are sent to Uttar Pradesh, Madhya Pradesh, Mumbai, Delhi and abroad. There they are subjected to physical abuses, sexual assault and unspeakable atrocities.

As per a media report carried out on 26th October, 2022, the Caste Panchayats in Rajasthan committed these crimes on the lines of Syria and Iraq where the girls are enslaved. Reportedly, in Bhilwada, rather than going to Police in matters of financial disputes, involved parties approached the Caste Panchayats for its settlement. It became the initiation point for making the girls slave and if they are not sold; their mothers are ordered to be raped.

Further, the news report revealed that in order to pay off Rs. 15 lakh debt, a Caste Panchayat forced a man to sell his sister first. The crime didn’t end there. Later, he was forced to sell his 12 year old daughter. Reportedly, the buyer brought the girl for Rs. 8 lakh. Thereafter, all the five sisters became slaves, but the debt remained.

In another incident, a man took out a loan of Rs 6 lakh to avail treatment for his ailing wife. In order to settle the loan, he sold his young daughter for Rs. 6 lakh to some people, who took her to Agra. Later, the young girl was sold three times and became pregnant four times.

Apart from seeking a report from the Gehlot government, the NHRC has sent its Special Rapporteur, Mr. Umesh Kumar Sharma, to visit and inspect the affected areas in Rajasthan. He has to submit a comprehensive report on the incidents noted about and the prevailing practice in the area. This too will move at ‘legal’ snail’s pace. He has to submit his findings within three months.

The state government and law enforcement agencies should wake up from their slumber. They have to make sure that these cruel TALIBANI practices, which were unheard of in any civilised society, are put to an end at the earliest, not in months or weeks, but within days and all the perpetrators should be booked and tried for life imprisonment or capital punishment in the court of law. Till then, the financial power on which they carried out these unspeakable horrors should be razed down to the ground ASAP.
