In a democratic society, both the permanent and political executive plays an important part in governance. One is directly elected by the people and bears their legitimacy, while the other is chosen on merit to bear the intellect of governance. Political executives have legitimate responsibilities of the people, and they have to stand in the people’s court every five years.
As a result, they have the authority to appoint such officers who may pledge to uphold the efficiency of administration and assist the political executive in fulfilling the aspirations of the people.
Prime Minister Modi, clearly understands that a successful tenure requires an efficient administration, implemented a number of policies to ensure the cleanliness of bureaucracy.
On the one side, he ensured the capacity building of bureaucracy through Mission Karmayogi. On the other hand, he supported for effective administrators to lead the various statutory and constitutional organisations.
Sanjay Kumar Mishra, the Director of the Enforcement Directorate (ED), is one of many such upright officials for whom PM Modi bends every norm in the book.
Who Is SK Mishra ?
Sanjay Kumar Mishra, originally from Uttar Pradesh, is a 1984-batch Indian Revenue Service (IRS) officer of the Income Tax Cadre. Due to his economic acumen and upright character, he steadily rose to the top position in the administration. He investigated many high profile Income Tax cases and took them to the final conclusion.
Considering his career profile, SK Mishra was appointed as Principal Special Director in the ED on November 19, 2018. Consequently, he was made the director of the ED. His tenure in ED was set to expire on 16 November 2021.
However, considering the intensity of the investigation related to money laundering in the country, his tenure was extended through the ordinance.
PM Modi Bends Every Rule in the Book to Retain SK Mishra
His time as ED Director was set to conclude in two years when he was appointed in November 2018. However, through the order, the central government retrospectivelyamended his initial appointment to 3 years.
Common Cause, a public advocacy organisation, contested the order on the grounds that it is a blatant violation of the Supreme Court’s direction.
Hearing the case, the Court had upheld the order of the government and directed the government not to grant SK Mishra any additional extensions.
The government, however, promulgated an ordinance to amend the Central Vigilance Commission Act. The ordinance extended the ED Director’s tenure by up to 5 years. According to the constitutional mandate, the ordinance was finally replaced with the Act in December 2021.
Why Left-Liberals Groups are Against SK Mishra
PM Modi had such faith in SK Mishra that he not only issued an order to keep him, but also passed a law to extend his tenure. SK Mishra earned PM Modi’s trust through his unending strike against economic fraud in India.
During his term, SK Mishra investigated a number of money laundering cases that had effectively stifled the nation’s progress. He made certain that those who stole people’s money were held accountable.
Here is a list of the cases he is handling:

Aside from these high-profile financial fraud cases, SK Mishra is also managing global fraud cases for NGOs such as Amnesty International.
SK Mishra has brought these cases to conclusion, stealing corrupt people’s dreams. That is why, in order to stop him, the entire left-liberal fraud has teamed together. Several writ petitions have been filed before the Supreme Court in order to overturn this order.
The central government has maintained in the argument that the petitioners are purely politically motivated, and that tenure was enhanced in the public interest and in accordance with the CVC Act.
Furthermore, the central argued in court that legislative motive cannot be susceptible to judicial scrutiny. The Act is altered in order to get a favourable outcome in the Financial Action Task Force’s evaluation.
In a sense, PM Modi made every legal move necessary to keep SK Mishra in the system. PM Modi’s choice to support his officers clearly indicates his great desire to eliminate corruption. The political leadership’s faith in bureaucracy allows them to work freely to build the rule of law in the system.
Incorruptible character, integrity in work, and adherence to the rule of law distinguished SK Mishra as a true soldier of democratic India. This is why a populist leader like PM Modi has such high regard for him.
