The Delhi Police has urged a Delhi court to award the Death penalty to former AAP councillor Tahir Hussain and four other convicts in the murder of Intelligence Bureau staffer Ankit Sharma during the 2020 northeast Delhi riots. The prosecution made the submission during the sentencing phase after the accused were convicted, arguing that the nature of the crime places it within the “rarest of rare” category under Indian law. The court is now considering the prosecution’s plea alongside the defence’s submissions before deciding the appropriate punishment.

Appearing before the trial court, the prosecution argued that the brutality of the crime warranted the maximum punishment available under the law. According to the Delhi Police, the victim was subjected to a sustained and violent assault, resulting in numerous injuries. Prosecutors contended that the attack was not spontaneous but reflected a calculated act carried out during the communal violence that engulfed parts of northeast Delhi in February 2020.

The prosecution’s request for the Death penalty was supported by its assertion that the offence had a profound impact not only on the victim’s family but also on public confidence in the rule of law. It argued that crimes of such exceptional gravity deserved the highest level of judicial scrutiny and punishment. Referring to established legal principles governing capital punishment in India, the prosecution maintained that the present case met the threshold prescribed by the Supreme Court for awarding the ultimate sentence.

During the hearing, the Delhi Police reportedly described the attackers as having acted with extreme cruelty, pointing to the medical evidence presented during the trial. The prosecution highlighted the post-mortem findings and the circumstances surrounding the victim’s death, submitting that the evidence demonstrated exceptional brutality. Based on these findings, prosecutors argued that the Death penalty would serve the interests of justice and reflect the seriousness of the offence.

The defence, however, strongly opposed the prosecution’s plea. Lawyers representing the convicted individuals argued that the case did not satisfy the legal standards required for imposing capital punishment. They urged the court to consider mitigating circumstances, including the personal backgrounds of the convicts and the principles laid down by the Supreme Court regarding sentencing. The defence maintained that life imprisonment would be a more appropriate punishment if the court deemed a severe sentence necessary.

The sentencing proceedings have drawn significant public attention because they relate to one of the most closely watched criminal cases arising from the 2020 Delhi riots. The riots resulted in more than 50 deaths and widespread destruction of property, leading to numerous criminal investigations and prosecutions. The murder of Ankit Sharma became one of the most prominent cases due to the victim’s role as an Intelligence Bureau employee and the extensive evidence examined during the trial.

While pressing for the Death penalty, the prosecution also argued that the punishment should act as a deterrent against similarly grave offences. It submitted that the criminal justice system must send a clear message that acts involving extreme violence and loss of life will attract the most stringent consequences permitted under law. Prosecutors maintained that imposing the highest sentence in appropriate cases reinforces public faith in the administration of justice.

Legal experts note that Indian courts apply a stringent standard before awarding capital punishment. The Supreme Court’s “rarest of rare” doctrine requires judges to carefully balance aggravating and mitigating circumstances before deciding whether the Death penalty is warranted. Courts also examine factors such as the nature of the crime, the manner in which it was committed, the possibility of reform of the convict, and the broader interests of justice. Each case is evaluated on its own facts rather than through automatic application of the maximum punishment.

The court has reserved its order on sentencing after hearing detailed arguments from both sides. Until the judgment is delivered, the prosecution’s request remains a submission before the court rather than a final judicial determination. The defence is expected to continue emphasizing mitigating factors, while prosecutors insist that the circumstances justify capital punishment. The final decision will determine whether the convicts receive the Death penalty, life imprisonment, or another sentence permitted under Indian law.

The outcome of the sentencing hearing is likely to be closely followed by legal observers, policymakers, and the public alike. Regardless of the eventual verdict, the proceedings underscore the importance of due process during the sentencing stage of criminal trials. As the court weighs the prosecution’s plea for the Death penalty against the defence’s arguments, the case remains a significant example of how India’s judicial system approaches punishment in serious criminal offences while adhering to constitutional safeguards and established legal principles.
