The Ministry of Information and Broadcasting (I&B) has recently issued a stern advisory to media entities, online advertisement intermediaries, and social media platforms regarding the display of advertisements related to betting and gambling. Citing concerns over the involvement of black money and the socio-economic risks posed, the government is taking proactive measures to safeguard consumers, particularly the youth, and protect the financial security of the nation.

The recent advisory issued by the Ministry of Information and Broadcasting (I&B) carries significant weight, underscoring the severity of the issue surrounding gambling and betting advertisements in India. In its advisory, the Ministry has emphasized the urgent need for all stakeholders, including media entities, online advertisement intermediaries, and social media platforms, to immediately refrain from displaying any form of advertisements or promotional content related to betting and gambling.

Press Council Act, 1978

The Press Council Act, 1978, establishes the Press Council of India, which is tasked with ensuring the freedom of the press and maintaining high standards of journalistic ethics. Advertisements promoting gambling and betting may be subject to scrutiny under this act if they violate ethical standards or contribute to the dissemination of harmful content.

In addition to these statutes, the amended rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, holds particular significance in restricting the promotion of online games that are not verified as permissible. This rule imposes obligations on intermediaries, including online platforms and social media networks, to ensure that they do not host or promote content that is in the nature of an online game that is not verified as permissible.

These advertisements glamorize and normalize risky behavior, creating a false perception of easy wealth and success.
