Amit Shah and Sohrabuddin case: The saga of a political witch hunt

As the 2019 general elections are approaching, the Lutyens’ cabal has started its campaign for the Congress. Certain sections in the media have come up with a report claiming that Chief Investigating officer Sandeep Tamgadge told a CBI court that the incumbent BJP President- Amit Shah- and three IPS officers were the main conspirators behind the alleged fake encounters of Sohrabuddin Sheikh and Tulsiram Prajapati. It is important to note here that Amit Shah and three other have been discharged by the trial court in the case. However, Sandeep Tamgadge made it very clear that his claim is not supported by any documentary proof. But the Congress ecosystem is trying its level best to hide this fact.

However, a perusal of records and evidences which are in public domain only goes on to prove that sudden media reports against Amit Shah are nothing but a sordid witch-hunt against him rather than failure of criminal justice system.

To begin with, the fact that Sohrabuddin was a dreaded terrorist is not disputed by anyone not even by UPA government. It is very well established in a judicial verdict of TADA court that Sohrabuddin was found to be in possession of more than 80 AK-47 rifles, hundreds of AK 47 cartridges and hundreds of hand grenades. He was convicted for the same by the TADA court. All these sophisticated weapons were recovered from his farm in Madhya Pradesh at a time when the Congress was in power in the state.

After the killing of Sohrabuddin, the matter appeared before the court and it was up to the court to decide whether terrorist Sohrabuddin was killed by security forces in a genuine encounter or he was killed in a fake encounter. The erstwhile UPA government brought CBI into the picture to find out that terrorist having links with LeT was killed in a genuine encounter or a fake encounter. The CBI commenced its investigation to anyhow drag the names of eminent political leaders of the BJP in the encounter. So, basically a political vendetta was planned against the BJP politicians with the help of bureaucratic nexus.

As the events unfolded it became clearer. The CBI went to the extent of arresting Amit Shah who was the then Gujarat Home Minister under the then Chief Minister of the state and the present Prime Minister- Narendra Modi. Amit Shah was in charge many other important portfolios. Whatever happened in the case was shocking to say the least. The CBI arrested Amit Shah without interrogating him. The leading investigating agency directly sent him to judicial custody without any interrogation. Later on, when Gujarat High Court released him on regular bail, it observed that there is no evidence or material against Amit Shah. The honorable High Court reached to this conclusion after examining the allegations of Sohrabuddin being used for extortion etc. The CBI challenged Gujarat High Court’s decision in Supreme Court but the CBI lost in apex court as well.

The SC thereafter directed transfer of trial of Sohrabuddin case from Gujarat to Maharashtra, and the judge who was to undertake the trial was ordered to be selected by the administrative committee of the High Court of Bombay consisting of Chief Justice and other four Judges in order of seniority. The said session judge, so selected by the administrative committee of the Bombay High Court, again examined the so-called evidences produced by the CBI team against Amit Shah accusing him of conspiracy, extortion etc., and discharged him from all the offences categorically holding that the implication of Amit Shah by the CBI is purely on political grounds. The attempts made by the political rivals of Amit Shah to challenge the said order of discharging him of all offences passed in 2014 repeatedly failed up to the SC.

The incumbent BJP President Amit Shah, thus, stood the judicial scrutiny and was discharged by a valid order of a competent court from all charges including the charges of murder, extortion etc. Now, the important question is why this issue came to the forefront suddenly at this stage?

There were two CBI officers who investigated the offence and who implicated Amit Shah in the offence in an investigation which the court held to be politically motivated. These two officers were Mr. Amitabh Thakur and Mr. Sandeep Tamgadge. These two officers were called for recording their disposition before the trial court as the trial of Sohrabuddin case is going on. Obviously these witnesses, who themselves were guilty of fabricating evidence and falsely implicating an individual, would stick to their version which was already there in the charge sheet from which Amit Shah stood discharged by the court four years back.

It is because of the said dispositions of these two investigating officers that some media houses have started raising the issue which has been buried after a detailed judicial scrutiny. A detailed scrutiny of the records clearly reveals that this is a classic case of political witch hunting which failed due to timely intervention of the courts. Amit Shah is not relieved or discharged by CBI but by the competent court itself. It is therefore, a sordid saga of political with-hunting ahead of 2019 general elections rather than failure of criminal justice system.
