The senior citizens and elderly people in Uttar Pradesh need not worry any longer if they are being mistreated by their children or not being taken care of, as the Yogi Adityanath government is getting ready to bring in an amendment which will make it possible for parents, who have passed off their properties to their children, to retrieve such assets back from them. The new rules would mandate children to take proper care of aged parents, failing which, parents can take back their properties and effectively kick out children from their homes owing to their misdemeanour.
ANI reported that the Uttar Pradesh State Law Commission (UPSLC) on Friday submitted a proposal to Chief Minister Yogi Adityanath for amending the Maintenance and Welfare of Parents and Senior Citizens Act-2007 to enable the senior citizens to take their properties back from their heirs over negligence.UPSLC has proposed that the deed of the gifted property will stand cancelled following a complaint by an elderly person. It has also proposed that if children or relatives living in the house of elderly persons do not take care of them or treat them inappropriately, they can be “expelled from their home”.
As per the Senior Citizens Maintenance Welfare Act, a senior citizen including a parent who is unable to maintain himself from his own earning or out of the property owned by him shall be entitled to maintenance by the children and relatives. By amending the Maintenance and Welfare of Parents and Senior Citizens Act-2007, the Yogi government of Uttar Pradesh would make life better for aged parents who suffer at the hands of selfish, indifferent and thankless children. It will ensure that elderly people of the state lead a life of dignity and do not have to depend on their children for basic amenities and housing.
UPSLC Chairman Justice (retired) Aditya Nath Mittal told ANI that he presented the report to the Chief Minister.
“He was very happy. He said that the elders should definitely be respected,” Justice Mittal said. He said that the Chief Minister also asked why society will respect those who do not respect their aged parents. The remarks of Yogi Adityanath make it clear that the empowerment of elder people in Uttar Pradesh is just around the corner. The Uttar Pradesh model must be emulated across the country, and the respectful maintenance of aged parents must be made mandatory for their children.
