The Supreme Court today dismissed a number of writ petitions seeking a probe in Justice Loya’s death. In its statement, the honorable Supreme Court observed that there is absolutely no merit in the petitions regarding Judge Loya’s death and that his death was natural. In a damning indictment of frivolous petitions, the honorable Supreme Court Bench hearing the case observed that ‘frivoulous and motivated petitions should be discouraged’. The Bench, comprised of CJI Misra, Justice D. Y. Chandrachud and Justice A. M. Khanwilkar, admonished the politically motivated petitions and termed these as nothing more than an attempt to malign the judiciary. CJI Misra further noted that Supreme Court is not a place to settle political scores and such rivalries should be played out outside the Court. In further admonishment to the politically motivated petitioners, the honorable Supreme Court bench noted that attempt of the petitioners was to malign the judiciary and there is no reason to disbelieve the judicial officers.

The honorable Supreme Court Bench took exception to the arguments of Senior advocate Dushyant Dave, one of the petitioners and senior counsel in Justice Loya case, reprimanding him for ‘going to the extent of insinuating the judicial officers in unrelated cases.’

Although CBI said Justice Loya had died in Nagpur on 1st December, 2017, the political scavengers in India had then somehow overlooked the possibility of creating doubts about the death of the late CBI Judge, milk it and derive benefit out of it. They seemed to have woken up rather late to the opportunities provided to them by the death of the CBI Judge. It was only in December 2017, interestingly just before the crucial Gujarat election, where the prestige of the Prime Minister Narendra Modi and BJP President Amit Shah was at stake that the political scavengers began feeding on the issue of the unfortunate demise of CBI Justice Loya.
Till recently, the matter of Justice Loya’s death was listed before a bench of Justice Arun Mishra and Justice M Shantanagoudar. Advcate Dushyant Dave and Indira Jaising had argued before the bench that the Supreme Court must not hear the case as a similar case filed by Bombay Lawyers Association was already pending before the Bombay High Court. Dave had informed the Court that he was representing the Bombay Lawyers Association, headed by one Ahmed Abdi, before the Bombay High Court. Justice Arun Mishra who had almost broken down at the customary morning tea on Monday morning in the Judges lounge at the Supreme Court after questions were raised over his integrity and competence has in the latest order after the hearing of Justice Loya’s case asked the matter to “put up before the appropriate bench”.
The honorable Supreme Court’s verdict is a shot in the arm for BJP and a scathing indictment of ‘misplaced activism’ of opposition and ‘left-liberal’ media which has been politicizing the issue to further their agenda. With the Supreme Court judgment, the Justice Loya case will be laid to rest, hopefully.
