Some parts of the Telecommunication Act 2023 have been implemented from June 26, 2024. This new law introduces several important changes aimed at making the use and regulation of communication media in the country more transparent and effective. It includes provisions for the purchase and use of SIM cards, as well as penalties and fines for communication media misuse.

Background and Objective of the Law

The Telecommunication Bill was passed in Parliament in December 2023 and subsequently received presidential assent. This law is divided into more than 60 sections, detailing various provisions. The main objective of this law is to modernize the regulation of communication media by replacing a century-old law.

This law includes provisions for the establishment of communication media, their use, and penalties and fines for their misuse. Through this, the government aims to ensure that communication media are not misused and are used in a safe and controlled manner.

Rules for Buying SIM Cards

Under the Telecommunication Act, an individual in India can now purchase a maximum of 9 SIM cards in their lifetime. These SIM cards will be linked to their Aadhaar card or other identification documents. In Jammu and Kashmir and Northeast states, this limit is 6 SIM cards. Violating this rule will result in a fine of ₹50,000 for the first offense and ₹2 lakh for each subsequent violation. However, there will be no imprisonment for exceeding the SIM purchase limit, only fines will be imposed.

The main purpose of imposing a limit on SIM purchases is to prevent misuse. Previously, terrorists and other anti-national forces could activate multiple SIMs based on a single identification document, increasing security risks. This will no longer be possible.

Penalties for Illegal SIM and Internet Use

Those who use a SIM or the internet without legal permission will face heavy fines. According to the new law, a fine of up to ₹10 lakh can be imposed in such situations. This means it will become difficult to use the internet or other such facilities without legal permission.

Punishment for Providing False Information

The new Telecommunication Act imposes severe penalties for providing false information when purchasing SIMs or using internet services. Offenders can face fines up to ₹50 lakh and a 3-year prison sentence. This stringent measure aims to combat the rising tide of crimes facilitated by fake SIMs, including fraud, identity theft, and terrorism.

By implementing such harsh consequences, the government seeks to deter potential criminals and ensure that all telecommunication users are properly identified and accountable. This provision is crucial for enhancing national security and maintaining the integrity of India’s communication infrastructure.

Sanchar Saathi: A Helpful Tool

The government has recently launched a website called ‘Sanchar Saathi’. Through this website, people can obtain information about the numbers linked to their Aadhaar. To do this, users need to go to Sancharsaathi.gov.in and enter their phone number, after which this information will be provided through an OTP.

This website also provides the facility to deactivate unused SIMs and remove them from one’s Aadhaar. Additionally, the website offers the facility to block the IMEI number of lost mobile phones to prevent misuse.

The Telecommunication Act, 2023, is a significant step in regulating communication media. This law will not only help prevent the misuse of communication media but also provide users with more security and convenience. It is a necessary and welcome step to strengthen the country’s security and communication system. With the effective implementation of this new law, we hope that the use of communication media in the country will become even more secure and controlled.”
