Rahul Gandhi defamation case: Rahul Gandhi has suffered another setback. Sentenced to a two-year jail term in the 2019 criminal defamation case. It would be very naive to highlight the obvious fact that Rahul Gandhi is controversy’s favorite child. A plethora of news reports, articles, and debates have been written or aired that talk about his inaptitude, laughable, anti-logical statements, and political harakiri. But it is for the first time that fear of disqualification and jail terms looms large on the Gandhi scion.

‘Convict’ Rahul Gandhi

In a politically significant and historic verdict, a Surat court recently found former Congress President Rahul Gandhi guilty in the 2019 criminal defamation case. Chief Judicial Magistrate H. H. Verma pronounced the order in the presence of Mr. Gandhi and several senior leaders of the Congress Party.

The court delivered its judgment in the presence of heavy security arrangements on the court campus to prevent any untoward incidents from the defendant’s supporters.

The court sentenced Mr. Gandhi to two years imprisonment. However, the court also gave respite to the Wayanand MP and approved his bail on a surety of Rs 15,000. Additionally, the court stayed its verdict for 30 days so that Mr. Gandhi would have enough time to appeal the judgment in a higher court.

The Rahul Gandhi defamation case in fact

The criminal defamation case pertains to his 2019 remarks made during a Lok Sabha election rally in Karnataka’s Kolar. On April 13, 2019, he said, “Why do all the thieves have Modi in their names, whether it be Nirav Modi, Lalit Modi, or Narendra Modi?”

Following his outrageous remark, he had to face several protests for tarnishing the entire community with the broad brush just for political blame games. Later, former Gujarat minister and BJP MLA from Surat West Purnesh Modi filed a criminal defamation case against Congress mascot Rahul Gandhi.

Rahul Gandhi was charged under sections 499 and 500 of the Indian Penal Code. This states that anyone who makes or publishes an accusation about another person while intending to harm that person’s reputation or while knowing or having reason to believe that such an accusation will do so is considered to have defamed that person and is subject to a sentence of up to two years in jail.

Rahul Gandhi has been convicted u/s 499 and 500 of IPC. The sentence awarded is for 2 years and against that sentence, he has plead that he may be released on bail till appeal period and as per law, the Court has granted him bail for 30 days and until appeal, the sentence is… pic.twitter.com/d8TFyMcUi2

Congress workers started to stage protests in support of their convicted leader, Rahul Gandhi.

This is a Govt which uses outdated, crude, colonial tools to silence vocal political opponents. This is yet another example of a crude attempt to silence a political opponent. This judgement will be appealed, we know the playbook of the Govt. We are well prepared for it. Party is… pic.twitter.com/TY6a2D7nvr

In his first response to his conviction by the Surat Court, Rahul Gandhi tweeted MK Gandhi’s quote.

मेरा धर्म सत्य और अहिंसा पर आधारित है। सत्य मेरा भगवान है, अहिंसा उसे पाने का साधन।

The BJP’s top leaders also reacted to this matter and advised Mr. Gandhi to learn something from it.

Rahul Gandhi defies and disrespects every democratic institution, whether it is the Parliament or the judiciary. He should come out of this dynastic mindset and realise that no individual is bigger than the country, bigger than the people of India, bigger than the Constitution of… pic.twitter.com/qDqLES9wcs

Now, it will be seen whether Rahul Gandhi gets respite from the higher court or if his political time is up. If the higher courts also uphold this judgment, it will be tough for Congress, as his disqualification will be a no-brainer in that scenario.
