State vs Cyrus Hormusji case: Animal welfare and public safety are two important considerations in society. The proper treatment and care of domesticated animals is a moral obligation, yet at the same time it is crucial to ensure that such animals do not pose a risk to members of the public. The Mumbai Court has recently reinforced this principle in a verdict where it convicted a man whose Rottweiler inflicted harm upon a 72-year-old in a public place. The ruling highlights the importance of pet owners exercising reasonable care and caution when taking their animals out in public.
Mumbai Court finds owner of aggressive dog guilty
In the case of State vs Cyrus Hormusji, the Court convicted a Mumbai resident after his Rottweiler bit a 72-year-old man, finding that the owner was aware of the dog’s aggressive nature but failed to guard against danger to public safety.
Metropolitan Magistrate Nadeem Patel imposed a sentence of three months’ simple imprisonment and a fine of Rs. 1,000. The Court stated that it was the duty of the owner to take reasonable care when bringing such a dog to a public place and that leniency was unwarranted in cases where public safety was at risk. The Court also rejected the dog owner’s claim that the car and dog were not his, citing evidence of his taking the dog to the doctor.

The prosecution on the other hand, was successful in demonstrating the charges against the owner of the dog, Cyrus Hormusji, in accordance with Sections 289 and 337 of the Indian Penal Code.
The Hon’ble Court found Mr. Hormusji guilty in State vs Cyrus Hormusji case of recklessly managing a Rottweiler breed of dog. The said ruling serves as an illustration that, although the protection of animal rights is commendable, the paramount responsibility of pet owners is to ensure the safety of the public from their pets.
