Terming the alleged derogatory statement of BJP leader Nupur Sharma an act of blasphemy, Islamist forces have gone rampant all over the nation destroying public as well as private property. With the slogans like “Gustakh e Rasool ki ek hi saza, sar tan se juda” (Blasphamy of the Prophet is punishable by beheading), Islamists are creating spree of violence with the threat to behead, rape or kill a woman over a single statement. But, the person who is mainly responsible for spreading this mass hysteria against Nupur has his own house made of glass. Muhamed Zubair has accused Nupur Sharma of blasphamy, but what about Zubair’s repeated actions against ‘Hindu Devis and Devtas’?
FIR for deliberately outraging religion and beliefs
Owing to the same, a First Information Report (FIR) was registered on June 1, 2022, against Mohammad Zubair at a Police Station Khairabad, District Sitapur, Uttar Pradesh. He was booked under section 295-A of the Indian Penal Code and Section 67 of the Information Technology Act, 2000 for insulting religion and beliefs of Hindu monks.
The FIR has been registered against Mohammad Zubair for his insulting tweet on 27.05.2022, in which he used the hate offensive term “hate mongers” against the respected manager of revered religious place Badi Sanghat, P.S. Khairabad and National Patron of National Hindu Sher Sena, Mahant Bajrang Muni Ji. Zubair also insulted Yati Narasinghanand Saraswati and Swami Anand Swaroop.
The investigation will continue against Zubair
A writ petition was filed by Zubair seeking quashing of the FIR filed against him. The Counsel for Zubair argued that through his tweet he had not insulted or attempted to insult a religious belief of a class. It was also claimed that the FIR had been lodged against him just for harassment.
But citing the Neeharika Infrastructure Private Limited vs the State of Maharashtra case, the Allahabad High Court observed that the Court has the power to quash the FIR under section 482 of the Criminal Procedure Code. The Honorable Court only has to consider whether or not the allegations in the FIR disclose the commission of a cognizable offense and is not required to consider the case on merit.
The court further opined that the determination on the question of fact of the case can be discerned either through proper investigation or through proper trial in the court of law when the charge sheet is submitted. Making the prima facie case of proper investigation, the court dismissed the writ petition filed by Mohammad Zubair for quashing FIR against him.
Zubair – A habitual offender
Mohammed Zubair is a habitual offender who regularly posts Hinduphobic or anti-Hindu content on social media. In a series of insulting tweets against sacred Hindu symbols, mocking Shivalinga with the Vatican City he had said “this reminds me of @ShankhNaad post on Vatika-Vatican City”.

He has shared multiple posts insulting Sanskrit, Mahabharat, Ramayan, ancient scripture of Sanatan Dharma, and other religious identities & symbols of the Sanatan Dharma. A Twitter handle @The Hawk eye sharing the collage of Zubair’s defaming post against Sanatan Dharma states “it’s easy to make fun of others god, religion, culture & scriptures because there are no consequences. Ever tried this for own..?”

Hundreds of such Hinduphobic posts have been shared from his Facebook account. However, when his old anti-Hindu post started to go viral on social media, he immediately deleted his account.

When the case was registered against him for outraging religious feelings, he started to play the victim card. Triggering the mass violent protest in the entire country for an alleged derogatory statement, he has taken the recourse of alleged harassment for more grave offense. UP police must investigate his social media accounts and organization through which he has created mass unrest in the country.
