On Tuesday, West Bengal’s Advocate General (AG) Kishore Datta resigned from his post, marking an end to his nearly 4 years long tenure, citing “personal reasons”. Government sources however claimed that the resignation was linked to the state administration’s recent losses in several cases, including the post-poll violence case, in the Calcutta High Court.

Datta’s resignation letter:
Datta sent his resignation letter to Governor Jagdeep Dhankhar, Law Minister Moloy Ghatak and Chief Secretary Harikrishna Dwivedi. After Dhankhar accepted the resignation, the state government appointed Soumendranath Mukherjee the new AG.

Datta in his resignation letter, wrote, “I do hereby tender resignation as the Advocate General for the state of West Bengal, with immediate effect, owing to personal reason. Please accept the same. It was a wonderful experience working for the state of West Bengal.”
“In terms of Article 165 (1) of the Constitution of India Governor West Bengal Shri Jagdeep Dhankhar has appointed Shri Gopal Mukherjee, Senior Advocate of High Court at Calcutta, as Advocate General of the State and will hold office ‘during the pleasure of the Governor’,” Dhankhar tweeted.

Datta is the fourth advocate general of West Bengal to resign:
Kishore Datta had been appointed as the Advocate General in February 2017 after his predecessor barrister Jayanta Mitra had stepped down before the completion of his tenure due to ‘differences with the government’. Datta is the fourth advocate general of West Bengal in a row to have resigned from the post during Mamata Banerjee’s 10-year rule in the state. Anindya Mitra, the first advocate general to have taken charge after the TMC government came to power in 2011, and his successors Bimal Chatterjee and Jayanta Mitra had also resigned from the post.
BJP MP Slammed the TMC government:
BJP MP Arjun Singh slammed the TMC government for triggering Dutta to resign, he said, “Kishore Dutta is a gentleman. But he could not save the state government from embarrassment in the high court in several cases in the past. So, perhaps, he was forced to resign.”
Mamata’s fear of Indian Judicial system:
Mamata’s fear and hesitance towards the judiciary is legitimate as her concern lies in the fact that the judiciary might expose the TMC ‘reign of terror’ and dirty politics. The Calcutta High Court had prevented Mamata from exercising her tyranny in the State in many instances. Earlier in July, Calcutta High Court imposed Rs 5 lakh fine on Mamata Banerjee for appealing to remove Justice Kaushik Chanda from hearing her case against BJP leader Suvendu Adhikari’s election win in Nandigram. Justice Kaushik Chanda later withdrew and rescued himself from hearing the case. Back in August, the Calcutta High court ordered a CBI probe into the Bengal violence, which instigated Mamata to file a petition in Supreme Court against the High Court’s decision. It is very evident that the tyranny of Mamata’s administration had forced advocates to resign from their post, which further proves that no one wants to defend her authoritative rule.
