A Supreme Court bench led by Chief Justice of India Dipak Misra exposed the political conspiracies around CBI Justice Loya’s death. While dismissing a petition seeking an independent probe into CBI Justice Loya’s death, the apex court expressed anguish regarding how the PIL jurisdiction was misused for personal and political agenda. The bench also showed concern about the fact that in course of the petition and events related thereto serious personal attacks were made against the judges of Bombay High Court and even Supreme Court judges were not spared from mud-slinging.
This has led to a natural and justifiable demand from the BJP calling upon those who politicised the death of the departed soul in order to settle scores with BJP national president, Amit Shah. In fact, Maharashtra Chief Minister Devendra Fadnavis led the charge against the opposition asking the Congress, Communists and like-minded media houses who conspired to derive political mileage out of the tragic demise to apologise to the nation for misleading it and peddling lies against the BJP president, Amit Shah. UP Chief Minister, Yogi Adityanath also reiterated that the Supreme Court has clearly exposed that the controversial petition was filed for political reasons and was politically motivated. He went hammer and tongs after the Congress which stands exposed all over again. He demanded that Rahul Gandhi makes an unconditional apology to the nation for spreading falsehoods. Yogi Adityanath stated that the Congress had tried to create an atmosphere of hate and paranoia. Senior BJP leader Subramanian Swamy also took a dig at battered Congress president Rahul Gandhi and stated that it is unlikely for the Congress to apologise, even though they ought to. He pointed out that in the midst of this political controversy; judiciary’s reputation has been maligned for no fault on its part.

The fact that this petition was a façade had been pointed out by the Maharashtra government before the apex court in the previous hearing itself. It turns out that the Maharashtra government had been right all along. In the hearing that took place on 10th March, the Maharashtra government had pointed out that apart from politics there was nothing amiss in Justice Loya’s death.
Appearing for Maharashtra government, former Attorney General of India, senior advocate Mukul Rohtagi had pointed out that the four judges who were present at the time of Loya’s death had given hand-written statements to the effect that cardiac arrest was the cause of his death. He further stated that the post-mortem report revealed that Justice Loya was brought dead on the way to hospital. The Supreme Court in its judgment today has corroborated the submissions made by senior counsel Mukul Rohtagi. In what had turned out to be a dramatic clash between the petitioners and the government counsels, renowned advocate Harish Salve also blasted the opposition when it was suggested that the four judges present with CBI Justice Loya at the time of his death be examined before the Court. Harish Salve had come out all guns blazing in background of such insinuations being made against the honorable judges. The Maharashtra government had thus exposed the political conspiracy behind the misleading petition then and there itself.
It is shameful how in lack of any evidence, media outlets such as the Caravan which did 22 stories on the matter and the entire opposition held a media trial in which the BJP national president was held guilty.
There were no inconsistencies in the Justice Loya case and it is beyond comprehension how a cardiac arrest was spun off as a sinister conspiracy. Leave alone the question of thinking about the departed soul, the news traders, opposition and the petitioners did not even think about Loya’s family. They went on with their agenda even after Justice Loya’s son, Anuj Loya clarified that his family has no suspicion whatsoever with regard to his father’s death. With tears in his eyes, he had requested NGOs and politicians to stop harassing him and his family. He had further stated, “We faced some pressure from politicians and NGOs. We don’t want to name anyone, but please excuse my family from continuously asking about my father’s death.” It is heart-wrenching how the pain of a family which was already copping with the loss of a dear one was made to go through this ordeal just for political gains.
It is now obligatory on the part of those who tried to take the system hostage by massive propaganda and falsehood on Justice Loya case to apologise to the whole nation for misleading it, the judiciary for maligning it, BJP president Amit Shah for political vendetta against him and most importantly the family of the deceased for harassing it.
