SK Mishra – The man for whom PM Modi bends every rule in the book

Who Is SK Mishra ?

Sanjay Kumar Mishra, originally from Uttar Pradesh, is a 1984-batch Indian Revenue Service (IRS) officer of the Income Tax Cadre. Due to his economic acumen and upright character, he steadily rose to the top position in the administration. He investigated many high profile Income Tax cases and took them to the final conclusion.

Considering his career profile, SK Mishra was appointed as Principal Special Director in the ED on November 19, 2018. Consequently, he was made the director of the ED. His tenure in ED was set to expire on 16 November 2021.

However, considering the intensity of the investigation related to money laundering in the country, his tenure was extended through the ordinance.

PM Modi Bends Every Rule in the Book to Retain SK Mishra

His time as ED Director was set to conclude in two years when he was appointed in November 2018. However, through the order, the central government retrospectively amended his initial appointment to 3 years.

Common Cause, a public advocacy organisation, contested the order on the grounds that it is a blatant violation of the Supreme Court’s direction.

Hearing the case, the Court had upheld the order of the government and directed the government not to grant SK Mishra any additional extensions.

The government, however, promulgated an ordinance to amend the Central Vigilance Commission Act. The ordinance extended the ED Director’s tenure by up to 5 years. According to the constitutional mandate, the ordinance was finally replaced with the Act in December 2021.

Political Executive Trust on Bureaucracy

SK Mishra has brought these cases to conclusion, stealing corrupt people’s dreams. That is why, in order to stop him, the entire left-liberal fraud has teamed together. Several writ petitions have been filed before the Supreme Court in order to overturn this order.

The central government has maintained in the argument that the petitioners are purely politically motivated, and that tenure was enhanced in the public interest and in accordance with the CVC Act.

Furthermore, the central argued in court that legislative motive cannot be susceptible to judicial scrutiny. The Act is altered in order to get a favourable outcome in the Financial Action Task Force’s evaluation.
