There is a saying that the wheels of Justice turn slowly but it grinds exceedingly fine. This saying fits aptly on the alleged rioter and hate monger of the Aam Aadmi Party Amanatullah Khan. It is alleged that he instigated people, created an atmosphere full of communal hatred and carried out a whole lot of other illicit acts. Even after all these grave accusations were levelled against him, he kept on evading the law of the land. But not anymore, the authorities are finally tightening their grip against the AAP legislator Amanatullah Khan.
Assent for Prosecution
According to news reports, Lieutenant Governor (LG) of Delhi Vinai Kumar Saxena has given his assent to the Central Bureau of Investigation (CBI) to prosecute AAP MLA Amanatullah Khan. It is alleged that while serving as the Chairman of Delhi Waqf Board, the AAP legislator violated the rules and made “illegal appointments” to the board.
According to the sources, the sanction has been granted against Chairman of Waqf Board Amanatullah Khan and CEO of Delhi Waqf Board Mehboob Aalam.

As per a report by TOI, the LG has done this under Section 19 of the Prevention of Corruption Act, 1988, and Section 197 of the Code of Criminal Procedure, 1973.
After this sanction, both Amanatullah Khan and Mehboob Aalam will be prosecuted by the CBI for alleged commission of criminal offences that included deliberate and criminal violation of rules, regulations and law and misuse of position. They are also blamed for causing financial losses to the exchequer, during their terms as chairman and CEO of the Delhi Waqf Board, respectively.
As per a Hindustan Times report, an official of the lieutenant governor’s office was quoted as saying, “As per investigation of the CBI, Amanatullah Khan in connivance with Mehboob Aalam abused his official position and deliberately ignored rules and laid down procedures to cause huge losses to the government exchequer by arbitrarily appointing individuals by manipulating recruitment procedures to favour chosen individuals over thousands of deserving people who could have got employed had the process of appointment been transparent and impartial”.
After proper investigation, the central agency has found enough prosecutable evidence against Khan and Aalam. The authorities may prosecute them under sections 13 (1)(d) and 13(2) of the Prevention of Corruption Act, 1988, read with section 120-B of the Indian Penal Code (IPC) 1860.
Earlier, the CBI grilled AAP politician Amanatullah Khan for nearly six hours with regard to these irregularities in the functioning and day-to-day operations of the Delhi Waqf Board.
In the year 2016, the CBI had filed an FIR against him in this matter. Khan was booked under various charges including criminal conspiracy of the IPC.

The case started when the then LG Najeeb Jung dissolved the Delhi Waqf Board. He asked the CBI to probe into the alleged misappropriation of board funds and illegal appointments. The FIR filed by CBI alleged that the Delhi government under the dictate of the CM and deputy CM illegally scrapped/superseded the existing waqf board.
FIR claimed that it also constituted a new waqf board and a new chairman was elected. All these actions of the Delhi government were in contravention of the Waqf Act, 1955, and the Delhi Waqf Rules of 1977. The CEO and over 30 staff members were illegally appointed and employed on the waqf board. These violated Section 24 of the Waqf Act, 1955 and Delhi Waqf Rules, 1977.
Usual Denial from AAP
Just like in the previous criminal cases against its leaders and Ministers, the AAP backed its leader. They termed it a conspiracy of the BJP and PM Modi. The official statement issued by the party claimed that PM Modi feels threatened by Kejriwal’s success.

AAP’s statement said, “The PM and the BJP have started hating the Kejriwal government’s world-renowned work and have started to level crass and baseless allegations against AAP and its leaders. We expect many more such allegations in the coming days”.
It further alleged that “Prime Minister Narendra Modi was scared” of Mr Kejriwal’s political rise. Just like the episode of Satyendra Jain’s arrest, AAP will twist and turn its statement to claim itself as the victim of a larger conspiracy. Just like in Jain’s case they would and in the past had, turned Amanatullah Khan’s arrest into the persecution of the minorities within India. But it will never come out with strong will facts relevant to the case which can prove the innocence of their party and its leaders.

This waqf board illegal recruitment case is only one of many against the AAP MLA Amanatullah Khan. As the investigation progresses many more facts will come out tumbling from his dirty closet and the hate-monger will get the punishment he deserves for instigating mobs in the anti-CAA violent protests that turned into anti-Hindu Delhi riots. Seeing the gravity of the charges and the evidence gathered by the authorities it seems that he is going behind the bars for a very long time.
