Kashmiri terrorists Yasin Malik and Co will now be booked under UAPA

The Delhi NIA Court has framed Yasin Malik and 14 others under UAPA for 2017 cases related to terrorist and secessionist activities.

The Court’s Observations

 The NIA Court Special Judge Praveen Singh framed JKLF Chief Yasin Malik, Former MLA Rashid Engineer and 13 others under stringent Unlawful Activities Prevention Act (UAPA). The judge pointed out that there was a planned conspiracy and each conspirator knew each other well and there was a common Mastermind operating from beyond the borders such as Pakistan’s ISI. The court explained this as “orchestra conspiracy” and compared the tactics to Adolf Hitler’s Playbook.

“It has been argued that these were intended to be peaceful protests following the Gandhian path. However, the evidence prima facie speaks otherwise. Not only were the protests violent, but they were also intended to be violent. Thus, prima facie their plan was straight from the playbook of the likes of Hitler and the march of the Brownshirts. The object was to overawe the government by the sheer scale of violence and was nothing less than a plan for insurrection,”  the judge observed.

The court thought that none of the accused individually has argued that they had no secessionist ideology and objectives to break the erstwhile state of Jammu and Kashmir from the rest of the country.

The witnesses have connected many of them to All Parties Hurriyat Conference (APHC), its faction Joint Resistance Leadership (JRL). The All Parties Hurriyat Conference was formed in 1993 to give a political front to Secessionist activities. The money for all these illegal activities was channelized through Pakistani agencies, International terrorist organisations and even the diplomatic mission was used for such sinister designs.

The names framed include Kashmiri politician and former MLA Rashid Engineer, Pakistani terrorist and Lashkar-e-Taiba (LeT) founder Hafiz Saeed, Hizbul Mujahideen chief Syed Salauddin, JKLF Chief Yasin Malik, Businessman Zahoor Ahmad Shah Watali, Farooq Ahmad Dar aka Bitta Karate, Aftab Ahmad Shah, Avatar Ahmad Shah, Naeem Khan, Bashir Ahmed Bhat, Shabbir Shah, Masarat Alam and several others.

Encouraging terrorist justification

It has been seen in the past that terrorists like Yasin Malik even met the Congress PM.

Also, leftist journalists like Arundhati Roy hailed terrorist Yasin Malik and others as great leaders.
