Deep Sidhu, Farmers' protests, tractor march

Anarchist Deep Sidhu, who orchestrated the desecration of the Red Fort on January 26 this year during the tractor rally organised by protesting farmers has been in jail since February 9. However, on Saturday, the actor-turned-anarchist was granted bail by a Delhi court saying that the prosecution had sought to make an example of him since he was popular, but that this “hazards a failure of justice”, and that his continued detention was an infringement of his right to life and liberty. The grant of bail to Deep Sidhu on a personal bond of ₹30,000 and two sureties of a like amount had excited many on social media.

Among those happy for the supposed release of Deep Sidhu were the fake farmer activists, Khalistanis, liberals and the usual Modi-haters. They were beginning to rub the defeat of Delhi Police and the Union Home Ministry on the faces of authorities. Yet, to their astonishment, Deep Sidhu never set foot out of jail, as after being granted bail by the Delhi court, he was arrested once again by the Delhi Police’s crime branch in a separate case, for damaging the Red Fort. An FIR in the case was lodged by the Archaeological Survey of India (ASI).

The FIR was lodged against Sidhu by the Archaeological Survey of India, under Sections of the Prevention of Damage to Public Property Act, Prevention of Insults to National Honours Act and the Ancient Monuments and Archaeological Sites and Remains Act, Arms Act, rioting etc. Sidhu’s lawyer Abhishek Gupta called the “need and timing of the arrest extremely questionable” and said it is “a grave affront to personal liberty of an individual and runs foul of rights guaranteed under Article 21”.

While granting bail to Deep Sidhu, Special Judge Neelofer Abida Perveen said it would “violate and infringe the fundamental right to life and liberty as guaranteed to the accused-applicant” if he is denied bail on the nature of accusations and material alone. The court added that the police have seized clothes and a vehicle used by Sidhu to reach the spot, and “further incarceration for the sole purpose of voice sampling is not justifiable.”

Until his arrest, Deep Sidhu was being called a traitor to the farmers’ cause, and also an agent of the BJP sent with the sole motive of destabilising and defaming the agitation. After his arrest, however, the protestors had intriguingly begun asking for his immediate release.  The Delhi Police, however, is in no mood to let the anarchist slip away from its hands, since he will most definitely abscond and go into hiding once again.
