Jungle Raj and the prevention of Overtaking Act – An act to provide for a Comprehensive Law relating to the prevention of overtaking of vehicles belonging to the party members of JDU and RJD, and their family members, by making extreme provisions for on the spot death punishment of the offenders.

Be it proposed to be enacted by the legislature of the state of Bihar in the seventieth year of the Republic of India as follows:-

Short title and Commencement:

  1. (a) This Act may be called The Return of Jungle Raj and the prevention of Overtaking Act, 2016.

(b) It extends to the whole of the State of Bihar.

Definitions:

  1. In Jungle Raj and the prevention of Overtaking Act Act, unless the context otherwise requires, –

Section 1:

Whoever, dares to overtake a vehicle or vehicles in the state of Bihar, belonging to the party members of JDU or RJD, or MPs, MLAs, MLCs or even simple Karyakartas of these two parties, or family members of any of these, shall be punished with death with immediate effect, without any procedural complexities of Court trial.

Provided that there shall be no limitations whatsoever on the sentencing power of the party members of JDU and RJD, and their family members, whose vehicle or vehicles has been or have been, justly or unjustly overtaken.

Explanation 1: For the proper understanding of this section, it is hereby made clear that the right to give the punishment of death shall vest only in such Party members, MPs, MLAs, MLCs, Karyakartas and the family members of any of these, sitting in such vehicle or vehicles which has been or have been, justly or unjustly overtaken.

Explanation 2: For the purpose of any plea to pardon such heinous act of overtaking, all authorities of amnesty shall lie only and only with such party members, MPs, MLAs, MLCs, Karyakartas or the family members of any of these, whose vehicle or vehicles have been justly or unjustly overtaken, and no further clemency petition in this regard shall be entertained by any authorities.

Explanation 3: For the purpose of recognizing the vehicle or vehicles of the Party members of JDU and RJD, or MPs, MLAs, MLCs, Karyakartas, or the family members of any one of these, belonging to these two parties, the symbol of an arrow or that of the lantern, shall be sufficient to establish the guilt in case of committing the heinous crime of overtaking.

Section 2:

The pardoning power of the President and the Governor of the state, entrusted to them under Articles 72 and 161 of the Indian Constitution respectively, shall not be applicable in such heinous case of overtaking.

Section 3:

Notwithstanding anything in the Constitution of India, or any other law for the time being in force, no Court shall have any jurisdiction to take cognizance of any of the matters in relation to the aforementioned provisions of the Jungle Raj and the prevention of Overtaking Act.
