Gyanvapi masjid case: Varanasi Court upholds maintainability of Hindu side’s plea, next hearing 22nd Sep

In the Gyanvapi mosque complex issue, the maintainability of the Hindu side’s plea was upheld by the Varanasi Districts and Sessions court on Monday.

A petition was submitted by five women asking for permission to regularly worship Hindu gods whose statues are said to be on the Gyanvapi masjid’s (mosque’s) exterior wall.
The Gyanvapi masjid is a Waqf property, according to the Anjuman Intezamia Masjid Committee, who also questioned the maintainability of the plea.

On Monday, the Varanasi District Court denied the Muslim side’s petition. The court ruled that the Hindu parties’ lawsuit was maintainable.
The matter has been set for hearing on September 22 and the court will now consider the arguments on the merits.

The Gyanvapi Shringar Gauri dispute case was decided on 12th Sep, by a single bench of district judge AK Vishvesh.

As per the counsel Vishnu Shankar Jain, who is defending the Hindu side: “The court rejected the Muslim side’s petition and said the suit is maintainable. The next hearing of the case is on Sep 22,…”

Muslim petitioners are likely to file an appeal with the Allahabad High Court.

Prohibitory orders have been issued

According to Police Commissioner A Satish Ganesh, prohibitory orders have been issued in the Varanasi commissionerate, and officers have been urged to communicate with religious leaders in their respective areas in order to ensure that peace is maintained.

Shivling in Masjid complex

On May 16, 2022, the survey commission informed the supreme court that “Today on 16/05/2022, Shivlinga is found in Masjid Complex at the place where Waju Khana is there..” and prayed the court to direct the CRPF Commandant to seal the Waju Khana with proper force.

Concerning the matter, the local court order was passed ex-parte that “the DM, Varanasi is directed that the place where Shiva Linga has been found should be sealed with immediate effect and entry of any person should be prohibited in the sealed area”. Further, the court added that “with regards to the place being sealed the responsibility of supervision of what is being done by the administration shall be upon the Director-General of Police, Uttar Pradesh”.
