Chandigarh Case: P**n mafia and the crime syndicate should be hit hard

Chandigarh University Case: The essence of a woman’s modesty is her sex. From the time she takes birth, her sexual dignity is attached to her life. Any implicit or explicit attempt to outrage her modesty is a direct assault on her life. That is why the Indian Penal Code and other laws dealing with crime against women prescribe several punitive measures to stop this menace in the society. However, despite harsh laws and other provisions, the mighty Indian state is unable to stop this cancer from society.

Chandigarh Case

Media reports state that on September 18, 2022, a female student of Chandigarh University recorded videos of more than 60 female students while they were taking bath. She allegedly sent all these videos to her male friend from Shimla. Furthermore, when aggrieved female students went to the Chandigarh University administration with complaints, they tried to suppress the matter and did not inform the police of any action.

Against the uncooperative behaviour of the Chandigarh University, the female students launched a massive protest on campus. It was also reported that owing to the assault on their modesty, some female students tried to commit suicide on campus.

However, SSP Mohali, Vivek Soni has denied any suicide attempts or death reports, and stated that an FIR has been registered and the accused is arrested. It was also reported that the girl has shared only her video with her friend.

According to the latest update by DGP Punjab, three arrests have been made, two from Himachal and one accused. Electronic devices have been seized and a three all women SIT has been formed to investigate this matter.

The Syndicates of P*rnography

The whole episode of Chandigarh University in which illegal videos were made is not an isolated crime. It is a part of organised syndicates of p*rnography. There are numerous such cases in India and the world, where private obscene videos of females are made illegally and sold to p*rnography sites.

Reports suggest, the global market of p*rn is worth more than USD 100 billion. As p*rnography is not unlawful in the United States, they alone contribute to 10% of the world market. In India, section 292 and 293 of the Indian Penal Code makes selling, manufacturing, publishing and distributing p*rnographic material illegal in India.

In August 2015, the Indian Government had banned access to 857 p*rn sites. The Department of Telecom had notified Internet Service Providers (ISPs) to block access to these 857 websites, under Section 79(3)(b) of the Information Technology Act, 2000.

Section 79(3)(b) of The Information Technology Act, 2000 says that upon receiving actual knowledge, or on being notified by the appropriate Government or its agency that any information, data or communication link residing in or connected to a computer resource controlled by the intermediary is being used to commit the unlawful act, the intermediary fails to expeditiously remove or disable access to that material on that resource without vitiating the evidence in any manner.

Further in 2018, owing to a gangrape case in Dehradun School by her schoolmates after watching p*rn clips, the Uttarakhand High Court had asked the Central government to impose a strict ban on p*rnographic websites.

Human Lust Never Comes With Recession

Despite the ban, p*rnography websites are still accessible in India through VPNs (Virtual Private Network), DNS (Domain Name System) server changes, proxies and other tricks. The accessibility has sustained their business and these p*rn syndicates continue to flourish.

These sites monetise p*rnography materials through subscriptions and other methods. The small town criminals provide contents through illegal means. Sometimes, they lure vulnerable females from lower economic backgrounds to make such videos and the other times they obtain them through such scandalous means.

The female girl who allegedly had made the video of about 60 girls is a small part of this whole p*rnography syndicate. It is also possible that she may have been blackmailed by this guy to shoot these obscene videos.

The government needs to thoroughly investigate the incident taking cognizance of international p*rnography syndicates too. A woman’s life starts with sexual dignity and also ends with the same. Thus, it is imperative to bring the perpetrators of the crime to justice and dismantle the syndicate from the root.
