Yogi’s bulldozer model is iron tight, and now it has Supreme Court’s blessings

The punishment should not only be retributive to the offender but should also instill fear in the eyes of potential lawbreakers and Yogi’s bulldozer model is proving to be effective in this goal. This is Yogi’s second term in power and UP, which used to be the hotbed of violence, has not seen any such big riot or violence since then. However, the law breakers and their Khalifa’s are trying every way out to get immunity from their street violence tactics but such nefarious efforts are being declined successively.

Don’t rely on newspapers, rely on records

An application was filed by Jamiat Ulama-I-Hind in the Supreme Court of India, seeking direction from the State of Uttar Pradesh to ensure that no demolitions are carried out by the UP government without following due process. The application aligns with the earlier petition filed against Delhi’s Jahaganirpuri demolition drive.

Advocate CU Singh, appearing on behalf of Jamiat Ulama-I-Hind arguing against the UP government’s demolition activities against anti-social elements said that the demolitions of properties of the person involved in violent incidents following the alleged derogatory statement of Nupur Sharma violate the rule of law and the municipal laws.

Senior Advocate Harish Salve appearing for the UP government refusing allegation of breaking of the law said that “person who received notice doesn’t say this on affidavit that they have not received the notice and some other people say, I have read in a newspaper, the notice has not been given and that is why this becomes relevant”.

Further, the Solicitor General refuting the allegations of Jamiat Ulama-I-Hind said that “the petitioners rely on newspapers, we rely on records”.

Hearing the application, the vacation bench of Justices AS Bopanna and Vikram Nath listed the matter for next week and gave three days to the state government to file an affidavit in reply to the application, and orally opined that “make sure that nothing untoward happens in the meantime”.

Bulldozer – An instrument of order in society

The applications were filed by Islamic organizations following the violent protest in UP and action thereafter. In the course of the event, it was believed that Mohammad Javed, Central working Committee, Member of the Welfare Party of India was one of the conspirators of Prayagraj violence who reported to be called for a “bandh” in the district. Following this Prayagraj administration ordered the demolition of his house in the presence of Prayagraj District magistrate Sanjay Khatri and SP Ajay Kumar.

Recently, it has been seen that UP’s bulldozer model has successively achieved peace in society. The fear generated through the action of the government is bearing fruit and the state is reaching economic prosperity with recurring business investment. With about 20 crore people and a highly political environment, the government needs to have strong state machinery to deal with anti-social elements and the Bulldozer model is one such instrument.

Although lawbreakers are trying hard to escape from the might of law but government’s actions are justified by watching the violent history of protest. And, the Court’s order gives a clear indication that they are not in a mood to interfere in the administrative functioning of the state government till the time state is following due process.
