- It is seen that the Kerala govt. on multiple occasions has supported the worker unions and workers’ strikes.
- It is because most of the unions are CPI party affiliated.
- The cadre of the party consists mainly of the workers and their unions.
- So, the govt obviously and shamefully supports the unions and is thrashed by the Kerala court for doing that.
Hearing a Public Interest Litigation (PIL) filed by an Advocate to prohibit government employees to join the nationwide strike called by Central Trade Unions, Kerala High Court observed that,
“Government servants should not engage themselves in any concerted or organized slowing down or attempt at slowing down Government work or in any act, which tends to impede the reasonably efficient and speedy transaction of Government Work.”

Government employees have no right to strike
The court, quoting Rule 86 of the Kerala Government Servants’ Conduct Rules, 1960 observed that “the government servant has no right to participate in any strike.” Rule 86 of the Rules, 1960, further call for ‘severe disciplinary action’ for refusal of the government duty. The strike like situation affects the essential services delivery of the state.

The communist government of Kerala supporting the strike is Illegal
The Kerala High Court has also called upon the Communist Party of India (Marxist) government in Kerala for supporting the strike. The court said
“ The action on the part of the state of Kerala in impliedly supporting the general strike by not insisting attendance and not declaring dies non on the days of General Strike is highly illegal and unjust.” The court also observed that “It is the duty of the Government to prevent the Government servant from joining in strikes.”

The Strike
The two days bandh was called by some leftist supported trade unions against the government’s alleged wrong policies that are affecting farmers, workers and common people. The strike was mostly organized in the left ruling states. It was mainly against the government’s disinvestment policies in the public sector units. The government employees are against these reforms which will ultimately bring efficiency in management and business further easing the capital of the government.
The Government has no business to do business
Prime Minister Modi is against the policy which allows the government to stay in business. His view is that the involvement of government in business affects the paramount purpose of a business to earn profit. The engagement of government in business not only bring corruption, nepotism and favouritism to the system but also occupy the space of private industry which create value and innovation through profits which ultimately help in expanding the business.

The govt in business obstruct the recurring business and employment created by the participation of the private sector. Because the government welfare policies do not allow it to earn profit and further enlarge the business. Due to the Politics of Unionism, the continuous protest, strike or Bandh called by unions affect the business and efficiency of companies. The manifold increase in the GDP of India after the Liberalization-Privatization-Globalization reform in the 90s is evidence that leaving the essential services, governments should not engage in business.
The Bandh called by the leftist unions and supported by the leftist government was termed illegal and unjust by the Kerala High Court. The Government employees should refrain from joining the strike as it affects the essential services of the government, causing inconvenience to the General Public.
