The Unique Identification Authority of India, or UIDAI, issues Aadhaar, which is a 12-digit unique identity number. It is one of the most important forms of identity for Indian people. PAN, on the other hand, is a 10-digit alphanumeric number assigned by the Income Tax Department. A PAN card is required to complete financial transactions.

The Income Tax Authority has extended the Aadhaar PAN liaison period by three months until 30 June 2021, from the previous deadline until 31 March 2021. Given the difficulty faced by taxpayers, the Government has issued a communication extending the last date for indicating Aadhaar Number and connecting it to the PAN until 30 June 2021.

The government has announced a number of relief measures for taxpayers, including extending the service between PAN and Aadhaar from September 30 to June 30. If the PAN becomes invalid because it is not established or implied as prescribed, the consequences of the non-performance of the PAN shall apply to the individual. The same shall apply until the time when Aadhaar is linked. It is mandatory to include your Aadhaar number when submitting your income tax return, apply for a new PAN and claim financial benefits from the state such as pension, scholarships, LPG subsidies, etc. As soon as you link your PAN with Aadhaar, it becomes invalid and effective until and unless there is a date for linking.

A person who has a Permanent Account Number (PAN) on July 1st 2017 and is entitled to receive an Aadhaar number has the right to associate the PAN with Aadhaar as per section 139AA of the Income Tax Act. The section stipulates that a person who has been assigned a PAN on or before 1 July 2017 and is entitled to receive the Aadhaar number must provide this number on the day on which it is notified by the Income Tax Authority. There are no other provisions in this section relating to Aadhaar, Aadhaar registration number, income return or association of Aadhaar with PAN.

The process of filing tax returns is supposed to be the same, and the only change is to add the Aadhaar card number to the PAN if necessary. The IT department has set up an online facility to correct errors in names and other information in Aadhaar documents and PAN cards.

If someone does not connect their PAN card to the Aadhaar card by 30 September, the tax office will impose a penalty of 1,000 RS. The Panadhar link was first announced a few years ago, but due to the pandemic that has occurred twice, the deadline has been extended three times.

In the 2021 Budget, the Government introduced a new section 234H into the Income Tax Act, which requires individuals to pay a penalty if they are not connected before the deadline. Under the new section, a person who does not link their PAN or Aadhaar by the end date will pay a fine of up to 1,000 rupees. The section was introduced in the Finance Act 2021.
