The ace lawyer never wins an important case

Kapil Sibal, the senior leader of Congress party and a Supreme Court lawyer, will represent Indian Union Muslim League (IUML) – an offshoot of All India Muslim League, the party responsible for Partition of the country- in the apex court in its plea against Citizenship (Amendment) Bill, which seeks to provide Indian citizenship to members of minority communities in Pakistan, Afghanistan and Bangladesh that have fled religious persecution.

These communities include Hindus, Sikhs, Christians, Buddhists, Jains and Parsis, all of whom are in minority, and whose numbers have fallen drastically in each of the three countries. The bill has been passed by both houses of the parliament, but the presidential assent and court verdict remains.

Kapil Sibal, who has been leader of many fallen causes including that of Sunni Waqf Board in the Ayodhya case, has taken up the case. Sibal is set to lose the case as Article 11 of the Constitution (Parliament to regulate the right of citizenship by law Nothing in the foregoing provisions of this Part shall derogate from the power of Parliament to make any provision with respect to the acquisition and termination of citizenship and all other matters relating to citizenship PART III FUNDAMENTAL RIGHTS General) gives the parliament solemn authority to decide on the matters of citizenship. But, he has taken up many lost causes, which only establish the fact that he is the saviour of losers.

Previously, he had taken up the case of Subrata Roy in Sahara V/s SEBI case, Teesta Setavalad in Teesta Setavalad V/S Guj Government as well as Fund Fudging Case. He also fought against the government in the Rafale controversy.

“A successful politician is one who: makes the unconscionable sound reasonable and the reasonable sound unconscionable,” reads a poem by Sibal, which also signifies his brand of politics and law practice.

He is also appearing for Sharada Scam Trinamool Congress Govt. of West Bengal. He is also appearing for Sonia Gandhi and Rahul Gandhi in National Herald scam, N Srinivasan in BCCI scam, Vijay Mallya in Kingfisher Airlines, and Dayanidhi Maran in Telephone Exchange at Home Scam.

From the aforementioned cases, it is absolutely clear that every allegedly tainted, corrupt, sexual predator and anti-national knocks at the door of Kapil Sibal. He has lost most of the previous cases, and might lose the current ones. But, he is the lender of the last resort for the every person who is involved in illegal activities.

It is a surprise that Congress party carries a liability like him, which only re-emphasizes the people’s belief that Congress is a corrupt party.

Kapil Sibal also represented Anil Ambani in the Reliance Communication case against the Ericsson Company. This came at a time when Congress president Rahul Gandhi has been relentlessly insinuating PM Modi of extending an illegitimate benefit to Anil Ambani in connection with the Rafale deal. While the grand old party has been attacking PM Modi over his alleged association with the entrepreneur, one of its senior leaders is represented him in the Supreme Court.

Last year, when the report about Sibal representing Anil Ambani had come to light, Congress spokesperson Manish Tewari had said, “Well, you need to divorce the lawyer from the politics. Whenever we appear in the court we don’t appear as members of the Congress party but as officers of the court.”

A few months ago, Barkha Dutt has moved the Patiala House Court against Congress leader Kapil Sibal and his wife Promila Sibal, and their company Analog Media Private Limited, demanding damages of over Rs 74 lakh with interest, after the sudden shutting down of the English news channel Tiranga TV in July.

But, the liberal community did not start tirade against Kapil Sibal despite Barkha Dutt being one of the favourites, because it seems Kapil Sibal is too powerful to fight. The second reason why the liberal community had not waged war against Sibal is that ‘he is too important to be dumped’. Therefore, despite being the advocate of alleged corrupt and sexual predators, Sibal remains among the leaders of the liberal community of the country.
